Conditions:License issued subject to 1 year probation The Board is an agency of the State of Missouri created and established pursuant to Section 333.151, RSMo, and vested with the authority to execute and enforcing the provisions of Chapter 333 and portions of Chapter 436, RSMo. Karley Jayne Boston is an individual residing at 2154 S. Fairway, Apt. 103, Springfield, Missouri 65804. Boston submitted her "Application for Funeral Director's License" to the Board that she signed before a notary public on September 20, 2013. (the "Application"). Boston completed her requirements for licensure as a funeral director in April, 2015. Boston submitted her "Application for Embalmers License" to the Board that she signed before a notary public on September 25, 2013. In her Application for Embalmers License, Boston indicated she would be serving her apprenticeship at Greenlawn Funeral Home, Inc. under the supervision of Clay Adams, James Carver, Stephen K. Smith, and William Dickson Wisner. On October 1, 2013, the Board issued Boston a registration as an embalmer apprentice at Greenlawn Funeral Home, Inc. ("Greenlawn Funeral Home"). Boston left her employment at Greenlawn Funeral Home on April 9, 2014. Boston began employment at Springfield Mortuary Service on April 10, 2014. On April 15, 2014, Boston filed with the Board her Update Application For Registration As An Embalmer Apprentice in which she requested an updated apprentice registration authorizing her to serve as an embalmer apprentice at Springfield Mortuary Service under the supervision of Brian L. Simmons. On May 15, 2014, the Board issued Boston a registration as an embalmer apprentice to be served at Springfield Mortuary Service under the supervision of Brian L. Simmons. Boston submitted her "Affidavits of Practical Work Experience" to the Board on January 24, 2014, February 10, 2015 and on February 17, 2015. Boston is over the age of 18 years. Boston completed the statutory requirements for licensure as an embalmer on May 5, 2015. After discussion with Board staff about her embalming apprenticeship, Boston was requested to meet with the Board to discuss her pending applications. Boston appeared before the Board on June 25, 2015 and discussed her pending applications with the Board. Basis for Probation Boston began work at Greenlawn Funeral Home in July, 2013, but was not authorized by the Board for her embalmer apprenticeship until October 1, 2013. Greenlawn Funeral Home recorded on its embalming log that Boston embalmed a body of August 21, 2013. Boston began work at Springfield Mortuary Service on April 10, 2014, but was not authorized to work as a registered apprentice embalmer until May 15, 2014. On May 28, 2014, the Board received a faxed letter from Boston stating that she began working at Greenlawn Funeral Home in July, 2013 and requested the Board to consider her apprenticeship beginning in July of 2013 rather than on October 13, 2013 when the Board issued her apprenticeship registration. The Board conducted an investigation to determine whether Boston had engaged in unlicensed practice during any time when she did not hold an apprentice embalmer registration. As of May 29, 2014, Springfield Mortuary Service's embalming log indicated that Boston worked on embalming 22 bodies between April 19, 2014 and May 15, 2014. On her "Affidavit of Practical Work" submitted to the Board as evidence of completion of her embalmer apprenticeship, Boston indicated that she completed 25 embalmings at Springfield Mortuary Service between September 12, 2014 and October 1, 2014. An apprentice embalmer registration authorizes the apprentice to work as an embalmer, subject to the requirements of supervision contained in the law, at the location registered with the Board and under the supervision of the supervisor(s) registered with the Board. Boston engaged in the unlicensed practice of embalming by embalming bodies at both Greenlawn Funeral Home and at Springfield Mortuary Service during times when she did not hold proper apprentice embalmer registrations. Boston held out to her employers and to the customers of her employers that she was authorized to serve as an embalmer apprentice at times when she was not so authorized. The Board has cause to deny Boston's application for both a funeral director license and an embalmer license pursuant to Section 333.330.2 (6), (7), and (14), RSMo. The Board finds that issuance of a probated funeral director license and a probated embalmer license, subject to certain terms and conditions, in lieu of denial, will ensure protection of the public.
