Conditions:License issued subject to 1 year probation The Board is an agency of the State of Missouri created and established pursuant to Section 333.151, RSMo, and vested with the authority to execute and enforce the provisions of Chapter 333 and portions of Chapter 436, RSMo. Charles M. Hanson ("Hanson") is an individual who has registered his business address with the Board as 106 E. 3rd Street, Willow Springs, Missouri 65793. Willow Funeral submitted its "Seller Application" to the Board that Hanson signed before a notary public on April 4, 2014 (the "Seller Application"). Grounds for Denial The location currently licensed to Willow Funeral as a funeral establishment previously operated under a license issued to John Gilmore d/b/a Willow Funeral Home, license number 2005031951 (the "Old Willow Funeral Home") that lapsed as of December 31, 2011. The Old Willow Funeral Home held provider registration number 2005031950 that became void with the enactment of Section 333.315, RSMo, effective August 28, 2009. Old Willow Funeral Home never obtained a provider license as required by Section 333.315, RSMo. Hanson served as funeral director in charge for the Old Willow Funeral Home. As funeral director in charge of the Old Willow Funeral Home, Hanson was responsible for all aspects of the funeral home operations per Section 333.071 and 20 CSR 2120-1.040 (14) and 20 CSR 2120-1.071(10). Hanson continued to operate the funeral establishment and to practice as both a funeral director and embalmer at the Old Willow Funeral Home, even after its establishment license had lapsed. Hanson operated the Old Willow Funeral Home as a provider from August 29, 2009 until May 15, 2014, even though the Old Willow Funeral Home never obtained a provider license. Hanson operated the Old Willow Funeral Home, under the previous owner, as an establishment from January 1, 2012 until May 15, 2014. On May 15, 2014 when Hanson learned that the Old Willow Funeral Home's establishment license had not been renewed by its owner and that the owner had never obtained a provider license, Mr. Gilmore, Hanson closed operations of Old Willow Funeral Home and began the process to obtain the proper licenses to operate as a funeral establishment, a provider and a seller. Hanson holds funeral director license number 2007000940 which is current and active. Hanson appeared before the Board, at the Board's request, on June 25, 2014. On June 27, 2014, the Board issued Willow Funeral a funeral establishment license, subject to probation. On June 27, 2014, the Board issued Willow Funeral a provider license, subject to probation. The Board deems the Seller Application completed and filed on December 4, 2014. The Board has cause to deny the Seller Application pursuant to Section 333.330.2 (6), (7), (14) and (19), RSMo. The Board finds that issuance of a probated seller license, subject to certain terms and conditions, in lieu of denial, will ensure protection of the public.
