Conditions:Board issued license subject to 3 years probation The Board is an agency of the State of Missouri created and established pursuant to Section 333.151, RSMo, and vested with the authority to execute and enforcing the provisions of Chapter 333 and portions of Chapter 436, RSMo. Brok Phillip Dickey is an individual who has registered his address with the Board at 26109 S Skyline Dr., Harrisonville, Missouri 64701. Dickey submitted his "Application for Funeral Director's License" to the Board that he signed before a notary public on June 27, 2013 and the Board received on July 13, 2013 (the "Application"). Dickey is over the age of 18 years. Dickey has met the statutory requirements for licensure. Basis for Probation On the Application, Dickey answered "yes" to the question that stated: Have you ever been arrested, charged with or found guilty, or entered a plea of guilty or nolo contendere by a court (including a municipal court), pled guilty or nolo contendere to any traffic offense resulting from or related to the use of drugs or alcohol, whether or not sentence was imposed including a suspended imposition of sentence (SIS)? If yes, explain fully. Along with the Application, Dickey provided a written explanation of the charges filed against him and stated: On November 20, 2010 I got a DWI that was closed by an SIS and is indicated on the Docket sheet I have attached. Also on April 6, 2013 I got a DWI that P put in a guilty plea to. This is also indicated on the attached sheet. Court records from the City of Raymore, Missouri, confirm that Dickey plead guilty to DWI on April 21, 2011 and that he also plead guilty to DWI on June 20, 2013. Dickey has used a controlled substance or alcoholic beverage to an extent that such use impairs his ability to perform the work of a funeral director. The Board has cause to deny Dickey's application for a funeral director's license pursuant to Section 333.330.2 (1), RSMo. The Board finds that issuance of a probated funeral director's license, subject to certain terms and conditions, in lieu of denial, will ensure protection of the public.
